Community Associations

Community and Homeowners’ Associations can be faced with dozens of problems and questions, the answers to which are critical in keeping their community a nice place to live. Terra is available to counsel associations regarding the corporate, real estate, business and operational issues that regularly arise. These issues include:

  • Interpreting governing documents, Declaration of Covenants, Conditions and Restrictions, the Articles of Incorporation and the Bylaws of the association
  • Answering day-to-day questions regarding operational, governance, practical, and legal issues;
  • Reviewing and drafting contracts for the maintenance, repair, and operation of the community
  • Amending governing documents to conform with current or desired operation practices
  • Revival of the Declaration of Covenants pursuant to F.S. 720.403, et seq.;
  • Assisting the board of directors on fiscal matters, such as budgeting, levying special assessments, and establishing reserves
  • Establishing written procedures for collection of assessments, required collection notices and for prosecuting foreclosure or collections actions as desired
  • Enforcing the declaration of covenants through demand letters, mediation or other legal means

  • Review of insurance policies and selection of coverage
  • Drafting of rules, regulations, architectural guidelines, and establishing review procedures.
